Terms of Service
These Terms of Service ("Terms") govern your access to and use of Basstab Pro, including our website, web application, and desktop application (together, the "Service"). The Service is operated by Will Daley, a sole proprietor based in California, USA ("Basstab Pro," "we," "us," or "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old to create an account or use the Service. By using the Service, you represent that you meet this requirement.
2. The Service
Basstab Pro uses automated audio analysis, including machine learning models, to separate the bass part from a song and generate bass tablature and related practice tools. Some processing happens locally on your computer through the desktop application; other processing (including AI-assisted features such as chat) happens on our cloud infrastructure. Because the Service relies on automated analysis, transcriptions, chat responses, and other generated output may contain errors, omissions, or inaccuracies, and should be treated as a practice aid rather than an authoritative or professionally verified transcription.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate registration information and keep it up to date. Notify us promptly at hello@basstab.pro if you suspect unauthorized use of your account.
4. Your Content and Copyright
You may upload or import audio files ("User Content") for analysis. You represent and warrant that you own the User Content or otherwise have the necessary rights and permissions to upload it and to have it processed by the Service. You are solely responsible for your User Content and for complying with all applicable copyright and intellectual property laws.
To help identify commercially released recordings, the Service may run an automated audio-fingerprint check against a third-party database (AcoustID/MusicBrainz) and display a copyright notice when a match is found. This check is provided for your convenience only; it is not comprehensive, and the absence of a match does not mean a recording is free of copyright restrictions. Do not upload a recording unless you own it or have permission from the rights holder.
You retain ownership of your User Content. You grant us a limited, non-exclusive license to store, process, and analyze your User Content solely to provide and improve the Service to you. We do not claim ownership of tablature or other output generated from your uploads, and we do not use your User Content to train shared or third-party-facing machine learning models.
We will respond to well-founded claims that content on the Service infringes copyright. Contact hello@basstab.pro to report a claim, including the material you believe is infringing and your contact information.
5. Payments and Credits
Certain features require credits, which you can purchase through our payment processor, Stripe. We do not store your full payment card details; Stripe handles payment processing under its own terms and privacy policy. Pricing, including any differences between desktop-local and cloud-based analysis, is displayed in the Service at the time of purchase and may change going forward. Except where required by law, credit and other purchases are non-refundable once the associated processing has been performed.
6. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose or to infringe others' rights; (b) attempt to access accounts or data that are not yours; (c) reverse engineer, scrape, or interfere with the Service's normal operation; (d) upload malicious code; or (e) circumvent usage limits, paywalls, or access controls. We may suspend or terminate accounts that violate these Terms.
7. Third-Party Services
The Service relies on third-party infrastructure and service providers to operate, including Amazon Web Services (hosting, storage, and email delivery), Stripe (payments), Anthropic (AI-assisted chat), and AcoustID/MusicBrainz (audio fingerprinting). Your use of the Service is also subject to the applicable terms of these providers where relevant.
8. Termination
You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service, with notice where reasonably practicable.
9. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that transcriptions or AI-generated output will be accurate, complete, or error-free, or that the Service will be uninterrupted or secure.
10. Limitation of Liability
To the maximum extent permitted by law, Basstab Pro will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold Basstab Pro harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your User Content, your violation of these Terms, or your violation of any third party's rights.
12. Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in California.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
